Then the burden of proof is dependent on the accuser. We have a justice system that claims “innocence UNTIL proven guilty”. If nobody can prove that these were anything more than personal gifts, and the defendants (ie Trump) still claim they are personal gifts, then we must take their word for it. He already has personal relationships with these people, he has a history of large monetary gifts, and there is history that Presidents have done this in the past, just not to this magnitude. Unless someone can articulate why the amount is unlawful, Trump is in the clear on this one.
5 C.F.R. § 2635.201 - 205 govern the ethical guidelines that apply here. They prohibit federal employees from receiving gifts over $50 from individual sources per year with some carve outs and caveats. There’s usually some leeway — nobody’s investigating someone over $75 instead of $50 — but $45,000 is way over the threshold, so some
This does warrant ethics review. The closest I could find was 5 CFR part 2635 Subpart C which specifically prohibits gifts given from lower ranked officials two superiors There is also 18 USC to a one to consider but that would probably require a investigation to corruption or bribery. A gift of $45,000 is not something to be overlooked while not specifically illegal from what I can find. It seems highly suspect considering that all three aids are in key positions to Trump. When being on the fine arts committee that would approve the ballroom, Another that was involved in a Possible obstruction case that got dropped in 2024, And lastly, an aid who runs Trump’s socials of which he has used to great effect in his presidency. There should be investigation because it is too simple to say that they are personal gifts rather than supplemental or bonus pay or payment for quid pro quo purposes. All of the ads make over $150,000 a year we can debate how far this would stretch in DC.
As the former ethics chief acknowledged, there is not precedent set in this arena so it is critical that we establish that with this specific case. If the statute is designed to prevent private entities from currying loyalty from government employees, then that should absolutely apply to private individuals. This statute should be interpreted to not only be preventing corporations from buying the loyalty of these employees, but also to prevent individuals from doing so. There’s a reason the pay is higher for jobs that are unethical. This sets the stage for corruption. If the president uses the office to profit for himself, this opens the door to extend those profits to those who protect the office for him.
This case must be handled technically because this case was done, purposefully mind you, more of a legal grey area. People are trying to exploit this grey area to do something that is, by both law and general consensus, not right: they are trying to make it ok for cash sums to undermine the checks and balances that our legal system is created on and revolves around. These technicalities in the law stop people from using grey area to practically buy parts of the government, which, we should all agree, CANNOT be allowed to continue.
We know that this is not the first time that Trump has given large monetary personal gifts. He was on record doing this during his first time as well between the years 2016-2020.
How do you know it’s likely to be shut? Have you conducted the thorough investigation? The only way you can know with certainty if it would be shut or not is through an investigation. This is day one stuff it’s really not hard to wrap your head around it
No law has been broken because right now the money has not been linked to a salary enhancement. However, reviewing financial records, reviewing the employee’s work timeline, and speaking with other staff may show that it actually was related to their work and a salary increase.
